POLICIES AND CONDITIONS OF SALE
TERMS:
1. RECEIPT of your order constitutes a purchase contract which OBLIGATES YOU (the buyer) FOR the FULL COST of product ordered and is not subject to cancellation once the order is accepted and scheduled for production.
2. All prices are F.O.B. our Hamilton, Ohio address. A minimum 50% deposit is required on all orders with the remaining balance due C.O.D. In the event that final billing exceeds prepayment by not more then 30%, TechniGraphics Printing Specialties will ship the product with the outstanding balance billed Net Due On Receipt for established accounts of good standing.
3. OPEN ACCOUNTS: Net 10 day terms are available for established accounts of six months or more and may be applied for by submitting credit references. Credit limits are based upon the average monthly activity over the preceding six month period.
4. DELINQUENT ACCOUNTS: Accounts delinquent 30 days or more will be shipped C.O.D. Products ordered by accounts with checks returned for non-payment, for any reason, will be shipped C.O.D., for job(s) in progress or completed at that time, for the entire account balance due, plus current bad check and C.O.D. charges, payable by CASH, CERTIFIED CHECK or MONEY-ORDER ONLY. Accounts issuing bad checks are held liable for ALL COSTS, including cost of litigation, or any cost incurred in the collection of payment.
5. PAST DUE ACCOUNTS: Accounts past due over thirty (30) days will be charged two percent (2%) PER MONTH on the unpaid past due balance. Accounts past due more than sixty (60) DAYS FORFEIT wholesale or manufacturers' DISCOUNT STATUS and discounts will not be reinstated until account balance is paid in full. All work in progress for accounts over sixty (60) days past due will be shipped C.O.D., Cash, Certified Check or Money-Order and BILLED AT CURRENT RETAIL (Non-discounted) PRICES, ie: NOT at wholesale or manufactures DISCOUNT PRICES.
POLICIES AND CONDITIONS OF SALE:
1. TechniGraphics Printing Specialties assumes no liability for loss or replacement in kind or value of artwork, fine art, photo art, computer files or other materials supplied by it's customers. Artwork or other materials will be returned, when possible and practical, with the finished product or shipped and billed for return freight costs separately.
2. TechniGraphics Printing Specialties assumes no liability for copyrights or publishing rights or any fees or royalties associated with such rights of reproduction. Securing applicable rights and any and all legal liability for violation(s) of such rights criminal or civil, including any costs of litigation or losses incurred by TechniGraphics Printing Specialties as a result of any such violation(s), are hereby deemed the responsibility of those submitting such materials for reproduction. Any costs arising from such violations will be billed net due upon receipt to the account submitting such materials.
3. PRODUCT DELIVERY/ORDER COMPLETION: TechniGraphics Printing Specialties does not guarantee to meet either published or verbally quoted anticipated completion dates or deadlines and will not accept cancellation without charge once orders are accepted and scheduled for production. Prepayments, however, will be refunded less applicable charges on orders prior to scheduling or production.
4. GUARANTEED SHIP DATE ORDERS: Guaranteed ship date orders, IF OFFERED, will be shipped on the date corresponding to the published guaranteed ship date calendar date and corresponding file submission deadline of order receipt. NOTICE: Materials meeting our file format requirements are accepted on a first come first served basis, until production availability is sold out. In the event that a guaranteed ship date order is received and available space is sold out, the buyer will be notified of the delay by phone, if possible, or U.S. Mail, postmarked within 36 hours of receipt (Monday through Friday) or applicable receipt deadline. ALL Guaranteed Ship Date Orders will be acknowledged in writing and postmarked within 36 hours of receipt (Monday through Friday) or applicable receipt deadline, via U.S. Mail or electronic facsimile or e-mail where applicable. 5. PRODUCTION MATERIALS: ALL MATERIALS except for those materials supplied to TechniGraphics Printing Specialties or services sold exclusively as customer property in writing or on published price lists produced by TechniGraphics Printing Specialties or any sub-contractor of TechniGraphics Printing Specialties for the manufacture or production of the products sold by TechniGraphics Printing Specialties are solely and exclusively the property of TechniGraphics Printing Specialties including but not limited to: design, computer files, inter negatives, photo prints, transparencies, color separation films, line films, contact films, halftone films, proofs, printing plates, mechanical and/or photo mechanical art or materials.
6. LOSS LIABILITY: Under no circumstances shall TechniGraphics Printing Specialties be liable for, and you, your agent (buyer) or company expressly waives, through submission of any order, any claim for special or consequential damages including but not limited to loss of profits or liability for losses or costs of any taxes, royalties, copyrights, performance rights, fees, freight or storage charges, promotional, production or other expenses resulting from or occurring as a result of your ability or inability to utilize products either produced or not produced by TechniGraphics Printing Specialties for use in conjunction with any customer's product or services, beyond refund of payment made toward the purchase price of the product or services purchased from TechniGraphics Printing Specialties.
7. CHANGES TO SUBMITTED MATERIALS: No changes will be accepted to submitted materials once your order is accepted and scheduled for production.
8. CANCELLATION: Once your order is received, accepted or approved as final computer files and scheduled you are OBLIGATED to pay the MINIMUM COST OF PRODUCT ordered, plus charges for services completed or in production at the time cancellation is requested. EXAMPLE: If a standard size (2x3.5 inch) color photo business card is ordered with back printing and special photo manipulation, you are obligated for a minimum of the cost for a standard size (2x3.5 inch) color photo business card. If the photo manipulation is in progress or completed you are responsible for the charges for whatever photo manipulation that is already completed. Requests for cancellation may be made by phone, but must be confirmed in writing. Final billing for orders that are canceled will follow within the the billing cycle for the production group in which the order was scheduled. TechniGraphics Printing Specialties will not refund charges, which you may deem unrecoverable, as a result of delayed billing.
9. RETURNS: NO PRODUCT may be RETURNED WITHOUT our CONSENT. You must contact our offices via phone (1-800-722-2922), telephone facsimile (513-867-8245), electronic mail (Email: tprinting@cinci.rr.com - Web: www.tps-pac.com), or U.S. mail at: TechniGraphics Printing Specialties, 1135 St. Clair Ave., Hamilton, Ohio 45015-2051 BEFORE returning products. TechniGraphics Printing Specialties will either send you return documents for you to return the product in the original shipping package if shipped via commercial carrier or send you return postage paid packaging to return via U.S. Mail. You will be responsible for return freight charges for any order returned without our written consent. TechniGraphics Printing Specialties will reimburse return shipping costs for product returned, PROVIDED that TechniGraphics Printing Specialties has AUTHORIZED IN WRITING THE CARRIER and SERVICE used to return the product.
10. PRICE QUOTATIONS: TechniGraphics Printing Specialties will provide written price quotes upon request at the time of submission of ALL materials and instructions pertaining to the work to be quoted. Prices given verbally or in the form of acknowledgements or work orders are ESTIMATES ONLY and are subject to final adjustments at billing for unforeseen costs or additional services requested later in the production process.
11. PRICES/SERVICES: TechniGraphics Printing Specialties reserves the right to change prices or services without notice. Please call to confirm prices and secure a written price quote if needed. This is of particular importance if you are a broker and reselling our products.
